(*3.1)31

K.Albanian crime boss arrested in Ireland
28 November 2010 | 09:37 | Source: Tanjug
PRIŠTINA — Kosovo Albanian Enver Sekiraqa, suspected of a number of crimes in Kosovo including a murder of a policeman, has been arrested in Dublin on an Interpol warrant.
Kosovo Police Chief Resat Malici confirmed the arrest, adding that the Kosovo authorities were working to have the suspect extradited.
The media in Priština reported Saturday that the biggest name of organized crime in Kosovo had been arrested in Dublin.
The Irish Foreign and Justice Ministries are considering the option to extradite Sekiraqa to Kosovo, where he would be put on trial.
However, the main obstacle to this is the fact that Ireland and Kosovo do not have an extradition agreement.
The Kosovo authorities have been searching for Sekiraqa since 2007, after the murder of police officer Triumf Riza in August that year.
He was wanted by Interpol for organized and international crimes, sexual abuse, theft and crimes against life and health.

He is wanted under an Interpol red notice on charges of murder, extortion, attempted extortion, two counts of rape and grievous bodily harm.

Albanian Mafia figure, Enver Sekiraqa, known as “the boss of bosses” of organized crime, is wanted in Kosovo in the murder of police officer Triumf Riza , and for a lengthy list of other crimes , but he is living in Ireland and cannot be extradited from his safe-haven in the Emerald Isle -due to a lack of a lawful extradition treaty between Kosovo and the Irish Republic

Enver Sekiraqa (37) has been living in the southeast but has not been extradited because there is no extradition agreement between the Republic and Kosovo, and the European arrest warrant mechanism does not cover Kosovo.

Alleged Kosovo Gangster Enver Sekiraqa Arrested
Police arrested Enver Sekiraqa, the most wanted man in Kosovo, after four years spent on the run, when he decided to hand himself over.
Fatmir Aliu

Pristina
Kosovo and European police officers arrested Enver Sekiraqa on Friday, the EU’s rule of law mission, EULEX, said.
A EULEX spokesperson said that Sekiraqa had handed himself over to the authorities after four years in run.
“He handed himself over and is currently being interviewed by a EULEX prosecutor,” Blerim Krasniqi told BIRN.
Sekiraqa is believed to be a major player in international organised crime and is wanted, among other alleged crimes, for the murder of a police officer in 2007.
Triumf Riza was shot dead on the streets of Pristina by a hitman suspected of working for Sekiraqa in August 2007.
Sekiraqa then fled and was first reported to be hiding in Serb-run northern Kosovo, which remains largely out of bounds to Kosovo police. Later he was reported to be hiding in Ireland.
The Kosovo authorities issued an arrest warrant for him in 2008, and for two others, Rrahim Rrahman Avdullahu and Ilir Ymer Avdullahu.
On Friday, EULEX and Kosovo police detained him in the Pristina area of Kodra e Trimave.
A Kosovo police officer said that Sekiraqa “didn’t resist” arrest.
Sekiraqa is also sought by Interpol over allegations of murder, rape, other sexual crimes, organised crime and theft.
In September 2007, Sekiraqa’s restaurant in Pristina was damaged in a bomb blast. It was later found that the bomb was planted by six police officers who killed two people in a nearby cafe and injured many more.
The judgment convicting the two police officers of murder said that the explosion may have been an attempt to intimidate Sekiraqa from returning to Pristina.

Questions Linger Over Kosovo Mobster’s Record Verdict
A Kosovo court has jailed Enver Sekiraqa for a record 37 years – but the alleged mobster’s trial was a troubled marathon, featuring dozens of witnesses and a mass of conflicting claims.

“Gangster, bad boy, you can call Enver Sekiraqa as you please, but he only happened to be a witness of a war crime at the wrong place and the wrong time.”
This was the punch line that Kosovare Kelmendi, Enver Sekiraqa’s lawyer, repeated several times during her closing arguments at the trial in which her client was last week found guilty of inciting the murder of former policeman Triumf Riza.
This was only one of the several accounts that Sekiraqa’s defence presented to the court since October 2014, when one of the most debated trials in Kosovo commenced.
Sekiraqa’s defence, composed of Kelmendi and a Slovenian lawyer, Bostjan Penko, maintained that Arben Berisha assassinated the former policemen Riza in a personal conflict, and that the defendant had no role in the events.
However, prosecutors from the EU rule of law mission, EULEX, in charge of the case, argued differently.
Andrew Carney, a British prosecutor for EULEX, accused Sekiraqa of having ordered Riza’s murder on August 30, 2007.
He was mocked in court by the defendant himself who repeatedly labelled Carney prosecution a “political prosecutor”.
But Carney convinced the court that Sekiraqa was the key person in the murder case.
Whereas Berisha has already been jailed for 35 years for the murder, Carney maintained that he was only “the one who pulled the trigger” and that Sekiraqa ordered the assassination.
Carney called the defendant the boss of the “Sekiraqa group” and disregarded the arguments of the defence calling them “conspirative”.
According to the indictment, Adelina Ismajli, a turbofolk singer, was one of the factors that ignited a conflict between Riza and Sekiraqa, while other incidents contributed to the clash between the two.
Two Polish judges, Arcadiuzs Sedek and Mariola Pasnik, and a local judge, Naser Foniqi, issued what has been considered a landmark ruling, sentencing the defendant to 37 years in prison.
Sekiraqa, on the other hand, maintained during the trial that he had been targeted by powerful politicians who had been involved in war crimes.
According to him, his testimonies as a former prisoner of the Kosovo Liberation Army, KLA, made him a target for the police and the authorities.
Sekiraqa told international investigators he had been witness to many war crimes, but it is yet to be seen if he will actually appear as a witness in any cases.
Anatomy of a conflict:
According to witness accounts in the trial, early in 2000 policeman Riza was on a routine patrol with several UNMIK policemen when he stopped a car driven by Sekiraqa.
Sekiraqa, who the prosecution said already had a notorious reputation, allegedly reacted violently and threatened Riza with a hand grenade.
Other incidents between the two then occurred over the years, including rivalry over the singer and showgirl Adelina Ismajli, who the prosecution presented as the major cause of the escalation of the conflict.
Ismjali was allegedly Sekiraqa’s girlfriend and, when the two separated, became involved in a relationship with Riza. But Sekiraqa never let go of her – a version that was not contested by the defence.
Ismajli asked for her testimony to be given in a closed session and for Sekiraqa not to be present during her account. The latter approved sessions being held behind closed doors but allowed Sekiraqa to be in the courtroom.
While the role of Ismajli in the conflict remains unclear, according to Carney, her relationship with Riza gave it new momentum, becoming the subject of many threats and several ambushes. Riza’s car was burned in one instance.
Another major incident occurred in a Pristina casino between the two men, with Sekiraqa and his group on one side and Riza and his friends on the other.
While exact accounts of the incident are contradictory, there is no doubt that the conflict escalated, with shots being fired and several wounded on both sides.
“I will never forgive [my son] for not killing him [Sekiraqa] when he had the chance,” Shefqet Riza, the father of the victim, said at the trial, adding that his son’s sportsmanship made him spare Sekiraqa’s life.
The defendant admitted that he felt a certain gratitude towards the victim, surprisingly conceding that “he somehow saved my life”.
According to the prosecution, as events spiralled, Sekiraqa chose Berisha, a member of his group, to assassinate Riza.
The indictment says that on August 30, 2007, Berisha pulled the trigger of the gun that killed Riza – a brave man who fought crime and who, according to Careny, was shot behind his back.
According to Sekiraqa’s lawyers, the defendant had no relationship with Berisha and in no way encouraged, ordered or promised him a reward; Berisha killed the former policeman because Riza had beaten him several times.
But the prosecution produced among other evidence, several photographs and video footage, showing Sekiraqa and Berisha together, where the two appeared to be closely related.
The prosecution also showed evidence of dozens of financial transfers from Spain to Kosovo during August 21-23, 2007, worth 66,000 euros, which were delivered to Sekiraqa and his brother Naser.
The prosecution said that in the following years, Berisha’s family built an expensive villa, and that the money needed to build this could not be justified by his relatives, further claiming it as evidence that Sekiraqa had rewarded Berisha for carrying out the murder.
Troubled witness to war crime:
The murder of Riza is not the only crime which Sekiraqa witnessed. He and his defence witnesses claimed that the police and other Kosovo authorities had abused him for acting as a witness in war crime cases involving members of Kosovo’s political elite.
Sekiraqa claimed he had provided evidence to prosecutors, and that he had been questioned by the UN war-crimes court in The Hague and by EU and UN institutions in Kosovo.
Sekiraqa’s defence witnesses claimed at the trial for Riza murder that, during the raids in his home and on those of his relatives, the police used offensive language and even threatened to kill him.
“Take note that you will be left with one boy only, as we will kill Enver”, a relative of Sekiraqa’s said at the trial, recalling the alleged threats from the police.
According to the defence, fearing for his life, Sekiraqa became a fugitive and escaped abroad for several years, before handing himself over to the authorities.
From 2007, he was first reported to be hiding in Serb-run northern Kosovo, which remains largely out of bounds to Kosovo police. Later he was reported to be hiding in Ireland.
The Kosovo authorities issued an arrest warrant for him in 2008, but he handed himself in to the authorities in 2012.
In September 2007, Sekiraqa’s restaurant in Pristina was damaged in a bomb blast. It was later found that six police officers planted the bomb, which killed two people in a nearby cafe and injured others.
The judgment convicting the two police officers of murder said that the explosion may have been an attempt to intimidate Sekiraqa from returning to Pristina.
He always maintained that his problems were related to his involvement in investigations linked to a war crimes case.
“All the problems started from a testimony I gave to war crimes investigators from the Hague [Tribunal], and also because of certain translators who collaborated with criminal organisations,” Sekiraqa claimed during the trial.
The defendant also accused EULEX translators of having leaked information obtained by Kosovo’s secret services, and accused the police of stealing money and coffee during the raid on his bar.
During the proceedings, he made these allegations several times, claiming his case was a machination that included war criminals and gangsters in political circles.
It remains unclear under what arrangement Sekiraqa agreed to surrender, although prosecutor Carney told BIRN that Sekiraqa handed himself in, and his surrender was unrelated to any war crimes investigation.
“My understanding was that he handed himself in to face justice”, Carney claimed, adding: “He knew that he was wanted and that is why he handed himself in.”
Carney, however, admitted that when he turned himself in to the authorities, Sekiraqa gave a testimony to EULEX concerning alleged war crimes.
“When he did hand himself in, he was spoken to by other prosecutors about potential war crimes investigations, but that was something I was not involved in,” Carney said.
During the war of the 1990s, Sekiraqa claimed that the KLA imprisoned him in one of their several camps held across Kosovo. There, he said he saw war crimes committed by some senior members of Kosovo current elite.
During the NATO bombing of former Yugoslavia, from March to June 1999, the KLA, then fighting the Serbian police and military, had a base in the Albanian town of Kukes from where they conducted guerrilla operations across the border in Kosovo.
The KLA also maintained a network of prisons in their bases in Albania and Kosovo during and after the conflict of 1999.
These held Kosovo Albanians suspected of collaboration, Serbs and Roma. Some detainees were tortured and it also believed that some were killed.
In statements given to UN prosecutors in 2009 and 2010, more than ten individuals – almost all ethnic Albanians – described having been detained indefinitely, struck with sticks and other objects, and subjected to various forms of inhumane treatment at these camps.
Several witnesses stated that screams of agony from persons held in separate sets of cellblocks could be heard filtering through the corridors.
Kosovo is in the process of forming a new internationally backed court, which is expected to be based both in Pristina and The Hague.
The establishment of the so-called “specialist chambers” comes after the EU’s Special Investigative Task Force last July published the findings of a three-year investigation into allegations of KLA crimes.
Initial reports claimed that KLA members committed grave crimes against civilians, such as kidnapping, torture and even organ-harvesting.
It still not known if Sekiraqa will be a witness in some of the cases held before the special court, but he will definitely be in the courtroom for a while.
His lawyers has announced that he will appeal his 37-year sentence – a record in itself for the Kosovo judiciary.
