Fluturimi i premtuar, mashtrim. Kapiteni njoftohet se do të ikin kur të zëvendësohet stafi
Mashtrohen përsëri marinarët e anijes “Brustel”. Premtimi i pronarit Alban Tepshi, se pesë anëtarë të ekuipazhit do të fluturonin dje në mbrëmje nga Tripoli për në Tiranë, nuk është mbajtur.
Kapiteni i anijes, Armando Ulqinaku, konfirmoi dje se ishte informuar për anulimin e udhëtimit të tij dhe katër anëtarëve të tjerë të ekuipazhit. Ulqinaku është njoftuar për anulimin nga agjencia portale libiane, që ka marrë përsipër shërbimet për anijen “Brustel”. Agjenti i ka thënë kapitenit se riatdhesimi do të bëhet vetëm kur të bëhet i mundur zëvendësimi i ekuipazhit të anijes me marinarë të tjerë, gjë që thuhet se do të zgjidhet brenda një jave.
Në këtë mënyrë, marinarët e bllokuar që nga 3 marsi i këtij viti në portin libian të Misuratës, do të duhet të qëndrojnë në anije të paktën edhe një javë.
Dritan Muka, kunati i kapitenit të anijes “Brustel”, tha dje se ka humbur çdo shpresë se autoritetet shqiptare do ta zgjidhin situatën. “Tani më mbetet të shkoj vetë në çdo ministri dhe të marr konfirmimin se ata nuk bëjnë dot gjë. Pastaj të shkoj e të merrem vetë me pronarin e anijes dhe ta detyroj të paguajë për riatdhesimin e kunatit tim dhe të tjerëve. Nëse autoritetet nuk veprojnë, kjo do të jetë zgjidhja”, tha i revoltuar Dritan Muka, i cili për rreth gjashtë muaj i ka dërguar para kunatit të tij në çdo port që ai shkonte, pasi pronari i anijes nuk ia paguante rrogën dhe nuk i siguronte furnizime për një jetesë normale.
Dritan Muka thotë gjithashtu se premtimi për fluturimin e mbrëmjes së djeshme kishte qenë një mashtrim që një fillim, një manovër e pronarit për të fituar kohë. “Agjenti libian e njoftoi Armandon që të bëhej gati për një fluturim nga aeroporti i Tripolit në orën 19:30 të së enjtes. Por në të vërtetë, në këtë orë nuk kishte asnjë fluturim nga ky aeroport. Gjithçka ishte një sajesë, një manovër për të fituar kohë”, tha Dritan Muka, i cili mbante shpresë se çështja do të zgjidhej me ndërhyrjen e Ministrisë së Punëve të Jashtme.
Tashmë asgjë nuk është më e sigurt për riatdhesimin e marinarëve shqiptarë të bllokuar në Libi. Anija me 14 marinarë u nis nga Durrësi më 1 qershor të vitit 2009 dhe pas një udhëtimi të gjatë e plot peripeci nëpër detin Mesdhe u bllokua më 3 mars të këtij viti në portin libian të Misuratës. Aktualisht në anije qëndrojnë 11 marinarë, pasi tre të tjerë kanë arritur të kthehen në Shqipëri. Autoritetet portuale të Libisë nuk lejojnë nisjen e anijes për lundrim, pasi certifikatat e saj të sigurisë janë të skaduara dhe duhen rinovuar. Për këtë arsye anija është arrestuar bashkë me ekuipazhin që duhet të marrë leje për çdo zbritje në tokë. Pesë nga anëtarët e ekuipazhit nuk kanë marrë rrogat që nga muaji tetor i vitit 2009 dhe kanë kërkuar me ngulm riatdhesimin. Edhe dy anëtarë të tjerë të ekuipazhit kanë kërkuar riatdhesimin ditët e fundit, ndërsa sipas kapitenit Armando Ulqinaku, edhe katër marinarët e tjerë duan të riatdhesohen, por nuk kanë këmbëngulur, për sa kohë nuk kanë pasur probleme me pagesën e rrogave.
Në fund të muajit mars 2010, gazeta “Shqip” ngriti shqetësimin për kushtet e vështira në të cilat ndodhen marinarët e anijes “Brustel” dhe pas kësaj u vu në lëvizje edhe Ministria e Punëve të Jashtme. Por edhe me këtë ndërhyrje, çështja mbetet e pazgjidhur dhe gazeta do të vazhdojë ta ndjekë problemin deri sa pronari i anijes apo autoritetet shtetërore shqiptare të mundësojnë kthimin pranë familjeve të 11 qytetarëve të këtij vendi, të braktisur në Portin e Misuratas në Libi.

Case of Monika Kryemadhi v. Redin Hafizi
The object of the civil and criminal actions against Hafizi was an article about the accidental death of
two workers in a quarry located in Zall-Dajt (east of Tirana) in which, it was alleged, Kryemadhi had a
property interest.

According to the article, the two victims were untrained workers who were killed
while preparing one of the explosions used to obtain the stone. The article quoted statements by Zall-Dajt
villagers that Kryemadhi acted as the “boss” of the quarry and visited the site often “in a sport utility
vehicle to monitor the work.” The article also suggested that Kryemadhi was indirectly liable for the two
deaths:
… ten days before the incident Ilir Meta’s spouse, blinded by the profits of the [quarry],
had fired the dynamite experts and experienced miners, and replaced them with strapped
[untrained] fellows that are in abundance in that area. One of the fired dynamite experts
related that Monika fired them because they refused to accept a salary reduction.
The article went on to claim that the “massive explosions” and the “lack of the most basic technical
security” at the quarry could one day “blow up an entire village.” It concluded by accusing the quarry
management of failure to pay workers social security and other benefits as required by law.

Case of Monika Kryemadhi v. Shemsi Peposhi
Kryemadhi brought civil and criminal defamation charges against Shemsi Peposhi for the following
passage in an article he published in RD, three days after Hafizi’s piece:
Kryemadhi … must publicly respond to the accusations against her, starting with the
railway coaches, the people she surrounds herself with, the two victims in Zall-Dajt, the
amount of money spent for the renovation to her taste of [a government residence] in
Durrës, and several privatization deals also in Durrës.
The accusations are very concrete and public … [that she] abuses money, arranges illegal
privatizations in favor of her relatives, that her relatives violate the law by abusing the
name of the prime ministerial couple, [and] she has been accused as the manager of a
[stone quarry] where two citizens lost their lives, and this is a crime.

The district court judge concluded, without any further discussion, that Peposhi, like the other two
defendants, “failed to prove [the truthfulness of] what he wrote, which clearly indicates that the
allegations he wrote were not true [and] were published with the sole purpose to harm the honor and
dignity of the accuser.”

Thus the judge improperly reversed the burden of proof in the case and
neglected the complete lack of any evidence on the record regarding Peposhi’s supposedly malicious
intent. Moreover, the trial judge failed to weigh several elements that distinguish Peposhi’s case from the
other two brought by Kryemadhi.
Peposhi’s piece was essentially a public challenge to Kryemadhi to respond to accusations that had
been previously made by other reporters within and outside the RD. In that and other respects, Peposhi’s
case is similar to the case of a radio journalist in Luxembourg who was sanctioned by the domestic courts
there for quoting parts from an article, written by another journalist, that were deemed defamatory of

Tashmë asgjë nuk është më e sigurt për riatdhesimin e marinarëve shqiptarë të bllokuar në Libi. Anija me 14 marinarë u nis nga Durrësi më 1 qershor të vitit 2009 dhe pas një udhëtimi të gjatë e plot peripeci nëpër detin Mesdhe u bllokua më 3 mars të këtij viti në portin libian të Misuratës. Aktualisht në anije qëndrojnë 11 marinarë, pasi tre të tjerë kanë arritur të kthehen në Shqipëri. Autoritetet portuale të Libisë nuk lejojnë nisjen e anijes për lundrim, pasi certifikatat e saj të sigurisë janë të skaduara dhe duhen rinovuar. Për këtë arsye anija është arrestuar bashkë me ekuipazhin që duhet të marrë leje për çdo zbritje në tokë. Pesë nga anëtarët e ekuipazhit nuk kanë marrë rrogat që nga muaji tetor i vitit 2009 dhe kanë kërkuar me ngulm riatdhesimin. Edhe dy anëtarë të tjerë të ekuipazhit kanë kërkuar riatdhesimin ditët e fundit, ndërsa sipas kapitenit Armando Ulqinaku, edhe katër marinarët e tjerë duan të riatdhesohen, por nuk kanë këmbëngulur, për sa kohë nuk kanë pasur probleme me pagesën e rrogave.
Në fund të muajit mars 2010, gazeta “Shqip” ngriti shqetësimin për kushtet e vështira në të cilat ndodhen marinarët e anijes “Brustel” dhe pas kësaj u vu në lëvizje edhe Ministria e Punëve të Jashtme. Por edhe me këtë ndërhyrje, çështja mbetet e pazgjidhur dhe gazeta do të vazhdojë ta ndjekë problemin deri sa pronari i anijes apo autoritetet shtetërore shqiptare të mundësojnë kthimin pranë familjeve të 11 qytetarëve të këtij vendi, të braktisur në Portin e Misuratas në Libi.

Die absolute Mafia
Case of Monika Kryemadhi v. Shemsi Peposhi
Kryemadhi brought civil and criminal defamation charges against Shemsi Peposhi for the following
passage in an article he published in RD, three days after Hafizi’s piece:
Kryemadhi … must publicly respond to the accusations against her, starting with the
railway coaches, the people she surrounds herself with, the two victims in Zall-Dajt, the
amount of money spent for the renovation to her taste of [a government residence] in
Durrës, and several privatization deals also in Durrës.
The accusations are very concrete and public … [that she] abuses money, arranges illegal
privatizations in favor of her relatives, that her relatives violate the law by abusing the
name of the prime ministerial couple, [and] she has been accused as the manager of a
[stone quarry] where two citizens lost their lives, and this is a crime.

The district court judge concluded, without any further discussion, that Peposhi, like the other two
defendants, “failed to prove [the truthfulness of] what he wrote, which clearly indicates that the
allegations he wrote were not true [and] were published with the sole purpose to harm the honor and
dignity of the accuser.”

Thus the judge improperly reversed the burden of proof in the case and
neglected the complete lack of any evidence on the record regarding Peposhi’s supposedly malicious
intent. Moreover, the trial judge failed to weigh several elements that distinguish Peposhi’s case from the
other two brought by Kryemadhi.
Peposhi’s piece was essentially a public challenge to Kryemadhi to respond to accusations that had
been previously made by other reporters within and outside the RD. In that and other respects, Peposhi’s
case is similar to the case of a radio journalist in Luxembourg who was sanctioned by the domestic courts
there for quoting parts from an article, written by another journalist, that were deemed defamatory of

nun läuft ein Straf Verfahren gegen den Botschafter Tephsi, der sein Vermögen nicht erklären kann. Die PDR Partei der Tepshi Brüder finanziert sich bekanntlich und in alter Tradition durch Drogen. Ein Sabri Godo, war sogar direkter Partner des Mafia Botschafters Josef Limpbrecht (bis Mai 2002) und konnte plötzlich 2 Hochhäuser, ohne Bank in Durres finanzieren. Der Drogen Clan der Gazmend Mahmutaj Brüder, sind da ein Schlüssel für die Organisierung dieser Geschäfte.

Ambasadori shqiptar në Çeki akuzohet për mosdeklarim të pasurisë. U denoncua nga ILDKP-ja
Ambasadori i Shqipërisë në Çeki, Qazim Tepshi, është vënë nën akuzë për “mosdeklarim të të ardhurave” nga Prokuroria e Tiranës, e cila ka përfunduar hetimet dhe ka dërguar çështjen në gjykatë. Diplomati rrezikon një dënim nga gjobë deri në tre vjet burg, nëse gjykata e shpall fajtor për akuzën e ngritur nga njësia Task-Forcë, e cila e ka hetuar ambasadorin pas kallëzimit të ILDKP-së.
Hetimi
Nga hetimi ka rezultuar se Tepshi ka “fshehur” pasurinë duke mos dhënë deklarime për rreth 70 mijë euro. Grupi hetimor i kryesuar nga prokurori Julian Xhengo u ka kërkuar bankave të niveleve të dyta informacione për pasurinë e diplomatit dhe ka rezultuar se ai ka kryer disa transaksione bankare me vlera të mëdha, të cilat nuk i kishte deklaruar në formularin e ILDKP-së. Prokuroria tha se Tepshi është thirrur tri herë për deklarime, të cilat i ka refuzuar. “Në drejtim të të hetuarit Qazim Tepshi janë dërguar tri fletëthirrje. Në asnjë rast, diplomati nuk ka pranuar të paraqitet para grupit hetimor. Fletëthirrjet janë dërguar edhe në Ministrinë e Jashtme shqiptare, e cila e ka vartës Tepshin, megjithatë ai nuk është paraqitur për të dhënë shpjegime për akuzat e ngritura nga ILDKP-ja. Pas hetimeve të plota të njësisë Task-Forcë, dosja është dërguar në gjykatë nën akuzën e ‘mosdeklarimit të të ardhurave’”, thanë burimet nga akuza qendrore.
Kallëzimi
Në kallëzimin referuar diplomatit, ILDKP-ja, pas përfundimit të hetimit administrativ, konstatoi fshehje të pasurisë e deklarim të rremë nga subjekti Qazim Tepshi, me funksion ambasador i Republikës së Shqipërisë në Republikën e Çekisë. “Qazim Tepshi, në deklaratat e tij të interesave private ndër vite nuk ka pasqyruar një shumë prej 35.000 eurosh, të depozituar në një nga bankat e nivelit të dytë që operojnë në Shqipëri. Po ashtu, ky subjekt nuk e ka deklaruar një transaksion bankar në shumën e 39.000 eurove, e cila i është kaluar në llogarinë e tij bankare nga një person i tretë. I pyetur lidhur me pasaktësitë e evidentuara nga Inspektorati i Lartë, Tepshi është përgjigjur se nuk e ka gjykuar të deklarojë këtë shumë. “Kjo shumë nuk është krijuar nga puna në ambasadë”, mësohet se ka deklaruar ambasadori para ILDKP-së. Këto argumente, Inspektorati i cilësoi si të pabazuara, duke i konsideruar shkelje të ligjit. Gjatë hetimit administrativ dhe korrespondencës me Drejtorinë e Përgjithshme të Tatimeve, Inspektorati i Lartë ka evidentuar gjithashtu se zyrtari me funksion ambasador, ka qenë administrator i një shoqërie private, aktivitet i mbyllur në vitin 2003, për të cilin ka mbetur pa shlyer detyrime tatimore në vlerën 2.666.192 lekë. Nisur nga këto të dhëna, Inspektorati i Lartë ka kërkuar nga organi i prokurorisë nisjen e procedimit penal për subjektin Qazim Tepshi, ndërsa organi i akuzës thotë se hetimet kanë përfunduar dhe Tepshi dyshohet se ka shkelur ligjin.
