Teil I in 2010: Der Unfug der Kosovo EULEX Mission, wo Nichts funktioniert

Mogherini Approves New EULEX Mandate in Kosovo

Kosovo’s assembly is expected to vote to extend EULEX’s mandate after EU foreign affairs chief Federica Mogherini backed a renewal of the mission with fewer competences.

The EU has finally approved an extension to the mandate of the EU’s rule-of-law mission in Kosovo, EULEX, which expired on Tuesday at midnight.

Federica Mogherini, the High Representative for Foreign Affairs and Security Policy, issued the approval in her reply to a letter from Kosovo President Hashim Thaci.

“I accept the invitation to your letter dated 9 June 2016 to continue to implement the mandate of EULEX KOSOVO”, Mogherini wrote.

Mogherini’s reply paves the way for the Kosovo assembly to vote two draft laws, approved by the government on Friday, which enable the EU mission to continue in the country.

She also agreed to Thaci’s demands in his letter to shrink the scope of EULEX’s work to a monitoring and advising role, rather than directly taking on high-profile cases of corruption and organised crimes, as it has done until now.

While EULEX is expected to continue working on ongoing cases, the mission can deal with new ones only in „exceptional circumstances“, with the approval of the Kosovo judiciary.

“The EU Special Representative and EULEX KOSOVO will continue to assist the institutions, the judicial authorities and law enforcement agencies in further strengthening an independent multi-ethnic justice system and police service in their progress towards fulfilling European Standards in their respective fields, including EULEX KOSOVO seeking new cases in exceptional circumstances,” Mogherini said in her letter.

Following the exchange of letters between Kosovo and the EU, the Kosovo assembly is expected to vote no later than Friday on the two draft laws that will reinstate EULEX’s mandate in the country, with diminished competences.

EULEX’s mandate expired on Tuesday at midnight after Kosovo and the EU failed to reach an agreement on an extension, which brought the mission to a halt.

Proceedings of several high-profile trials in which EULEX has a role have been interrupted and may not resume until the mandate issue is dealt with.

On Wednesday, two court sessions in Pristina were cancelled and postponed to later dates due to EULEX’s inactive mandate.

The trial of a Kosovo police official, Menderes Sinani, who EULEX prosecutors accuse of having sought a bribe from a suspect to drop a criminal investigation, was postponed after the participants waited for more than an hour.

Another more sensitive case that involves a former prominent legislator of the ruling Democratic Party of Kosovo, PDK, was postponed for the same reason.

The trial of Azem Syla, accused of running a criminal land-scam syndicate that cost Kosovo 30 million euros, was adjourned.

Avni Metra is fighting extradition from the United Kingdom after he was identified as an alleged gang member and a brutal two-time murderer in a Daily Mail investigation.

Wanted in Albania, where he was convicted in absentia of killing two brothers in 1997, it is believed Metra has been living under the name Avdul Mekra, claiming to be a refugee from Kosovo. Police say Metra gouged out the eyes and cut off the ears of one of his Albanian victims.

According to the the BBC, Metra had been living in a small home in the town of Borehamwood, England where he has four children.

Metra is also facing a rape charge in England. He will be facing a preliminary trial on Thursday, June 16 at the Westminster Magistrates‘ Court.

The judge told Metra, “The allegations you face in Albania could not be more serious – two counts of murder and possession of firearms. On the face of it you are a fugitive from justice in Albania. You have been living in this country for many years and I have not heard a satisfactory explanation as to why that should be.”

He was denied bail and an extradition hearing has been scheduled for Aug. 11.

Earlier this year, Albanian Minister of Justice Ylli Manjani called for the UK to extradite another Albanian murderer, Saliman Barci, who was also posing as a refugee from Kosovo.
