4 Monate gibt es nicht einmal eine Regierung, ein Debakel für die Deutschen Spinner, welche die Verfassung konstruierten, für ihre Mafiosi Partner im Auftrage des Verräters Frank Walter Steinmeier.

Es gibt wieder einen Visa Skandal in Phristina, mit gut gefälschten A1 Sprach Zeugnissen, des Goethe Institutes.

Die Präsidentin Atifete Jahjaga,hat bekanntlich gefälschte Schul Zeugnisse, gefakte Polizei Diplome, also eine Berufs Betrügerin. US installiert.

Jahjaga refuzon kërkesën e Bllokut

Presidentja e Kosovës, Atifete Jahjaga, ka refuzuar kërkesën e Bllokut LAN, të cilët kanë kërkuar nga ajo që të dërgojnë në interpretim pikën 127 të aktvendimit të Gjykatës Kushtetuese. Në arsyetimin e saj, Jahjaga shprehet se blloku duhet ta zgjidhë vetë situatën e krijuar në vend.

Sipas Presidentes, „është detyrë, obligim dhe përgjegjësi e të gjithë liderëve të partive politike parlamentare, si deputetë të zgjedhur të Kuvendit dhe si qytetarë të Republikës së Kosovës të punoni së bashku për të gjetur një zgjidhje të pranueshme dhe të qëndrueshme“.

 

 

Përgjigjia e plotë e Presidentes Atifete Jahjaga

Kam pranuar kërkesën tuaj të protokolluar me numrin 802 të datës 23 tetor 2014, me të cilën kërkoni që t’i drejtohem Gjykatës Kushtetuese për të sqaruar çështje të aktvendimit të saj nr. KO 119/14.

Duke marrë parasysh Kushtetutën e Republikës së Kosovës, dy vendimet e Gjykatës Kushtetuese dhe duke marrë parasysh rolin kushtetues të Presidentes si faktor i unitetit të popullit, e vlerësoj kërkesën tuaj, por besoj se është detyrë, obligim dhe përgjegjësi e të gjithë liderëve të partive politike parlamentare, si deputetë të zgjedhur të Kuvendit dhe si qytetarë të Republikës së Kosovës të punoni së bashku për të gjetur një zgjidhje të pranueshme dhe të qëndrueshme.

Zgjidhja duhet të gjendet brenda parimeve të përcaktuara, për ndërtimin e institucioneve të qëndrueshme, gjithëpërfshirëse, që do të punojnë në ndërtimin e shtetit të së drejtës dhe që do të përmbushin edhe pritjet e qytetarëve të vendit dhe gjithashtu edhe obligimet karshi bashkësisë ndërkombëtare.

Nisur nga të gjitha këto kërkesa, besoj se është e domosdoshme që liderët e partive politike parlamentare të pajtohen që të mblidhen në një takim të përbashkët në Zyrën e Presidentes. Qëllimi i takimit do të jetë gjetja e zgjidhjes përbrenda këtij kuadri të përcaktuar nga vendimet e Gjykatës Kushtetutës dhe në Kushtetutën e Republikës së Kosovës.

Mbes e gatshme të vazhdojë lehtësimin e procesit përmes të cilit liderët e partive politike parlamentare do të gjejnë zgjidhje për impasin e krijuar.

    Kosovo Doctors Suspected of Health Scam

    A group of doctors has been arrested on suspicion of abusing their positions to divert patients from the state health system to the private sector in return for bribes.

    Kosovo police detained nine doctors and three other health officials on Thursday, suspected of abusing their positions to send business to private hospitals in return for cash.

    They are suspected of signing deals with private hospitals to send patients for treatment there when public hospitals had the capacity to do the same treatments for free.

    “The defendants enabled the private hospitals to benefit by getting payment from the Health Ministry’s budget for the cost of treating patients who were sent there against official instructions,” the prosecution said.

    The procedures in question were mostly heart surgeries. One of the private hospitals with which the defendants signed the agreement to cooperate did not have a license to do heart surgeries.

    Prosecutors have not sought detention for three other officials who were interrogated in the round-up – including the Health Minister, Ferid Agani, and the former director of the University Clinic of Kosovo.

    The investigation into the alleged scam started in June.

    Besnik Berisha, a lawyer of Nexhmi Zeqiri, one of the doctors, said it was strange that the prosecutor requested detention only for the doctors and not for the other officials who were detained.

    “They are all suspected of the same charges, but the prosecutor has requested detention on remand only for the doctors,” Berisha told BIRN.

  2. Die Kosovo Verfassung ist sehr klar, von der teuren EULEX Mission ebenso bestätigt, das das Parlament die Verfassung Richter (max. 9) ernennt.

    Wie auch die Ukraine zeigte, ist Cahterine Ashton extrem dumm, kriminell und hat nur einen augeblähten Apparat hinterlassen, wo durch die neuen EU Botschafter noch mehr Verbrecher und NGO’s kriinelelr Clans hohe Geldsummen erhielten.

    Am gefährlichstten sind die extrem Dummen und nach einem Schriftwechsel von C.Ashton, ernennt der Präsident die Verfassungs Ricther. So gefährlich dumm ist die EU Commission, welche Berichte fälscht und schwachsinnig ist.

    Seit fast 5 Monaten gibt es keine Regierung im Kosovo, weil die Präsidentin Atifete Jahjaga,selbst nur gefälschte Schul Zeugnisse und gefakte Polizei Ausbildungs Diplome hat, eine Berufs Betrügerin kurz gesagt, vom US Botschafter A. Dell installiert.

    Court Challenge Threatens Kosovo President’s Position

    Ombudsperson’s case against judges’ reappointments to the Constitutional Court could disable the court and result in the President’s impeachment.

    Kosovo Constitutional Court has yet to decide whether it will hear a legal challenge questioning the legitimacy of the three international judges serving on it – and the President’s decree that confirmed their re-appointment.

    If the court agrees to hear the case filed on October 9 by Ombudsman Sami Kurteshi, it could render itself dysfunctional. It could also result in the impeachment of the President, which is why analysts doubt the court will hear the case.

    “This is a case with potentially serious consequences,” Fisnik Korenica, director of the Group for Legal and Political Studies, said. “If the court finds a serious violation of the constitution has occurred, it could be grounds for the dismissal of the President.”

    The dispute centres on the events of September 1, when President Atifete Jahjaga issued a decree confirming the continuation of the mandate of judges Robert Carolan, Snezhana Botusharova-Doicheva and Almiro Rodrigues.

    All three originally were appointees of the International Civilian Office, the body that oversaw Kosovo’s transition from UN Administration to independence and is now defunct.

    An internal memo of the EU rule-of-law body, EULEX, which Balkan Insight obtained, revealed that the President’s office had wanted parliament to nominate the three judges.

    The office also wanted them to swear an oath on their re-appointment. However, EULEX convinced the President’s advisers that this was not necessary.

    A ruling saying that the President violated the constitution by continuing the judges’ mandates by decree would destabilize the court because the three judges would then have to step aside.

    The court would then no longer have the quorum of seven it needs to make any decisions. Eight judges currently sit on the court (the ninth seat is vacant), one of whom must recuse himself from hearing any political cases.

    “No constitutional court in the world would follow a line [of logic] that would put itself out of action,” Korenica said, which is why he believes the court will declare the case inadmissible.

    “The Constitutional Court is a highly politicized institution. It is not there to interpret the Constitutional justly, but to serve as a political scale, to maintain balance and so-called political stability,” another political analyst, Shpend Kursani, said. “I do not believe … that the Court will act fairly on the Ombudsperson’s case,” he added.

    The European Union and the President’s office maintain that the decree continuing the judges in office was in line with an April “exchange of letters” between President Jahjaga and EU foreign policy chief, Catherine Ashton, which the Kosovo Assembly ratified.

    However, Ombudsman Kurteshi argues that articles 65, 84 and 114 of Kosovo’s constitution say that parliament must nominate all appointees to the Constitutional Court. Only then can the President confirm them.

    His interpretation, which matches the President’s own initial interpretation, prior to her discussions with EULEX, is that the exchange of letters with Ashton did not alter that requirement.

    In his submission, the Ombudsman requested “interim measures,” or an immediate decision by the court suspending the three international judges.

    Although court rules say such requests should be given priority over all other matters, the court has yet to respond.

    The three international judges will also likely weigh in on any decision concerning interim measures.

    The court told Balkan Insight it would not discuss any deadlines for a decision on interim measures.

    The legal tussle is another headache for President Jahjaga as she continues her efforts to break the four-month political deadlock that has followed since the last elections.

    Now a challenge to her own legitimacy hangs over her.

    The court has 30 days from the day it receives all the paperwork from the Ombudsman to decide whether the case is admissible. The President then has 45 days to issue a response to the challenge.

    “They have her [fate] in their hands,” Korenica concluded.

    Kosovo’s PM, Isa Mustafa will not participate in the Third Chinese Economic Summit, which will be held on Tuesday and Wednesday in Belgrade.

    This summit will see the participation of 16 prime ministers from Balkan countries. Chinese PM, Li Keqiang has promised around 10 billion Euros worth of investments mainly destined for the development of the infrastructure in the region.

    China has paid lots of attention to this summit, as the delegation will consist of over 100 state officials and 200 entrepreneurs who will participate in the forum.

    Chinese ambassador in Belgrade, Li Mancang has declared that Chinese investments will depend on the projects of the Balkan governments.

    Meanwhile, Albania is expecting Chinese investments in the sea transport, energy and other domains.

    Kosovo is not represented in this summit, as Kosovo’s PM, Isa Mustafa has not received an invitation from Chinese officials, due to the fact that China continues not to recognize independence of Kosovo and along with Russia, they’re two of the main countries who block its accession in the United Nations Organization.

    Experts of political developments in Kosovo say that China wants to expand its influence in the Balkan through investments, but they suggest that Kosovo must continue to preserve and improve relations with USA and EU.

    Analyst from Kosovo, Vilhard Shala sees the absence of Kosovo PM in this summit as a result of Kosovo’s unhealthy relations with China and the host of the summit, Serbia.

    “The absence was expected. Historically, our relations with China have not been that good, because this country has had an old friendship with Belgrade. Meanwhile, we all know that our most powerful allies are US and EU. Being a young state, perhaps we’re not in a suitable position to improve relations with new countries who are interested to increase investments and their impact in the Balkan”, Shala says.

    Meanwhile, analyst Shkelzen Dakaj says that under these circumstances, Kosovo must fanatically preserve good relations with USA and EU, being important allies who have helped in Kosovo’s becoming a state.

    “We cannot deny the fact that Brussels is worried about the fact that Chinese investments and commercial policies of the Asian country can challenge EU rules within its territory. Europeans are worried about the growth of Euro skeptics in the Balkan, but Kosovo must not see other alternatives besides integration in Euro-Atlantic structures which can offer a good perspective for Kosovo people”, Dakaj says.

    According to him, investments are welcome from any country, but their impact may worsen relations or lead to alliances that Kosovo has to be lost.

    He says that Kosovo and Albania will not benefit a lot from these funds, as investments are expected to be concentrated in Corridor 10 which goes through Serbia and FYROM and Corridor 4, which goes through Bulgaria and Romania. /ibna/
